CANCELATIONS WITHIN 7 DAYS BUT BEFORE 3 DAYS, ARE ELIGIBLE FOR A REFUND OF 50%. FOR EXAMPLE, IF YOUR RESERVATION IS FOR FRIDAY AT 8AM, THEN YOU MUST CANCEL BY 8 AM TUESDAY TO GET THE 50% REFUND.
THERE IS NO REFUND IF A CANCELATION (FOR ANY REASON) OCCURS WITHIN 72 HOURS BEFORE THE START OF THE RESERVATION.
ON A CASE-BY-CASE BASIS, RESCHEDULING MAY BE ALLOWED, BUT WILL FALL UNDER THE SAME CONDITIONS THAT EXISTED AT THE TIME OF REQUEST.

BAD WEATHER POLICY:
If there is inclement weather (storms with high winds, white-caps and/or lightning) at the time of your reservation, we (Fish Springs Marina) will allow cancelling of your reservation. If we allow cancellation of your reservation for inclement weather, we will offer you a refund or allow you to reschedule your reservation. Usually, we will know about potential inclement weather systems at least few days in advance. However, in most situations, we will not make an official rain/weather cancellation determination until the morning of the reservation. If you do not hear anything, that means we have not made a cancellation determination, and boats are expected to go out. Remember, rain/weather determinations are made by the Marina, not by renters.
Keep in mind that pop-up showers occur almost daily in the summer months and are not classified as inclement weather. During a pop-up shower, a pontoon may be driven back to the marina, or kept on the water at the customer’s discretion until the pop-up shower passes. There will be no refunds for early returns during pop-up showers.

ANYONE BORN AFTER JANUARY 1ST, 1989 MUST HAVE COMPLETED A STATE-SPONSORED BOATING COURSE TO RENT OR OPERATE A BOAT, INCLUDING RENTALS.

If you are planning on fishing during your visit to Watauga Lake, please read about license requirements in the fishing section of this web site. You may purchase your license online at Tennessee Wildlife Resources Agency web site, or buy your license in person at the marina when you pick up the boat. PLEASE ALLOW 8 TO 10 ADDITIONAL MINUTES PER PERSON TO PURCHASE FISHING LICENSE AT THE MARINA. NON-TENNESSEE RESIDENTS OVER THE AGE OF 16 MUST HAVE A PHOTO I.D. (DRIVER'S LICENSE) AND A SOCIAL SECURITY NUMBER, OR PREVIOUS TENNESSEE LICENSE. THOSE FROM 13 TO 16 YEARS OF AGE MUST PRESENT THEIR SOCIAL SECURITY NUMBER. THOSE UNDER THE AGE OF 13 DO NOT NEED A FISHING LICENSE.

200 HP - 25' Tahoe Tritoon (NEW) Policies
In consideration of the Agreement herein, LESSOR does lease or bareboat charter, to the undersigned (hearafter referred to as LESSEE) the craft and equipment described herein. LESSEE agrees said craft will not be occupied by a greater number of persons than is shown in this rental agreement. In the event the craft is not returned at the time specified herein, said LESSEE agrees to pay for OVERTIME AT THE POSTED RATE.
The LESSEE acknowledges he/she has carefully examined the craft and finds it suitable for the purpose for which it is leased and that other accessory equipment is in suitable and acceptable condition; that he/she will maintain both craft and equipment in a safe, dependable condition while in his/her custody.
LESSEE agrees not to use, nor permit the use:
Of the rental craft for any unlawful purpose, to carry any unlawful substance, or while under the influence of liquor and/or narcotics;
Of the rental craft in a careless or negligent manner.
By any other person not the signatory of this agreement or not equally qualified; or
Of the rental craft to discharge any unlawful pollution or litter.
LESSEE acknowledges his/her responsibility for the safe and proper operation of the craft and agrees to obey all applicable laws and regulations for him/herself, passengers, and for the safety and welfare of other boaters and persons. It is AGREED AND UNDERSTOOD BY LESSEE THAT THE LESSOR shall not be held liable for damages, inconvenience, or loss caused by accident, breakdown, or malfunction of the rental craft. LESSEE FURTHER AGREES to indemnify and hold harmless the LESSOR from and against any/all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation, or possession of said rental craft. LESSEE further agrees to hold the LESSOR harmless should loss or damages occur to any of the LESSEE’s personal property while carried in or on the rental craft including loss or damage caused by fire, water, theft, or any other cause whatsoever.
LESSEE expressly agrees to indemnify and hold LESSOR harmless of, from, and against any/all loss, costs, damages, attorney fee, and/or liability in connection with the enforcing of the foregoing rental contract by LESSOR, including expenses incurred in collection or attempting to collect delinquent rent and in the event of suit by LESSOR to recover possession of said rented property and/or to enforce any of the terms, condition, and/or provisions hereof. It is understood and agreed that venue of any action hereunder shall be in the county of LESSOR.
Upon return of the boat and equipment, an inspection will be made and any damages will be paid by LESSEE with a valid credit card. REMEMBER, YOU ARE RESPONSIBLE FOR ALL LOSSES AND DAMAGES caused by yourself, your passengers or otherwise. LESSEE is responsible for loss of income to LESSOR due to loss of service to vessel.
LESSEE agrees to indemnify owner for the full new replacement values of the craft and its equipment in the event it is confiscated by legal authorities.
NO REFUNDS will be made for poor weather or early returns.
The rules and regulations contained herein by the LESSOR are for the safety and welfare to all that use the facilities. The LESSEE certifies that he/she has read and understands said rules and regulations and further assumes the responsibility to see that his/her family and/or guest(s) will obey the rules.
NO OPEN FLAMES including, but not limited to, grills, fireworks, lanterns, etc. are allowed on rental boats.
This is to certify that I (we), the LESSEE(S) am/are capable in all aspect of the handling and operation of a craft such as the one rented above.

ASSUMPTION AND ACKNOWLEDGEMENT OF RISKS AND RELEASE OF LIABILITY AGREEMENT
In consideration of being allowed to participate in water sport events and activities and/or being provide with water sport recreational property of services, for myself and any minor children for whom I am parent, legal guardian or otherwise responsible, and for my/our heirs, personal representatives or assigns:
ACKNOWLEDGEMENT OF FISKS. Acknowledge that some, but not all, of the risks of participating in the water sport activity include: (1) Changing water flow, tides, currents, wave action and ships’ wakes; (2) Collision with any of the following: other participants, the watercraft, other watercraft, and manmade or natural object; (3) Wind shear, inclement weather, lightning variances and extremes of wind, weather, and temperature; (4) My sense of balance, physical coordination, ability to operate equipment, swim and/or follow directions; (5) Collision, capsizing, sinking or other hazard which results in wetness, injury, exposure to the elements, hypothermia, and/or drowning; (6) The presence of insects, and marine life forms; (7) Equipment failure or operator error; (8) Hear or sun related injuries or illnesses, including sunburn, sunstroke, or dehydration; (9) Fatigue, chill and or dizziness which may diminish my/our reaction time and increase the risk of an accident.
EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY. Agree to assume responsibility for all the risks of the activity, whether identified above or not, (EVEN THOSE RISKS ARISING OUT OF THE NEGLIGENCE OF THE RELEASEES NAMED BELOW). My/our participation in the activity is purely voluntary. I assume full responsibility for myself and any of my minor children for whom I am responsible, for any bodily injury, accident, illness, paralysis death, loss of personal property and expenses thereof as a result of any accident which may occur while I/we participate in the activity (EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE RELEASEES NAMED BELOW). I agree to wear a U.S. Cost Guard approved personal flotation device (life jacket) while participating in the activity or riding in any watercraft.
I hereby release Fish Springs Enterprises, LLC, DBA Fish Springs Marina, its principals, directors, officers, agents, employees, and volunteers, their insurers, if any, (Collectively “Releasees”) FROM ANY AND ALL LIABILITY OF ANY NATURE FOR ANY AND ALL INJURY OF DAMAGE (INCLUDING DEATH) TO ME, OR MY MINOR CHILDREN AND OTHER PERSONS as a result of my/our participation in the activity, EVEN IF CAUSED BY THE NEGLIGENCE OF ANY OF THE RELEASEEES NAMED ABOVE, OR ANY OTHER SPERSON (INCLUDING MYSELF).
I HAVE READ THIS ASSUMPTION AND ACKNOWLEDGEMENT OF RISKS AND RELEASE OF LIABILITY AGREEMENT. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM WAIVING VALUABLE LEGAL RIGHTS, INCLUDING AND AALL RIGHT I MAY HAVE AGAINST THE OWNER, THE OPERATOR NAMED ABOVE, OR THEIR EMPLOYEES, AGENTS, SERVANTS OR ASSIGNS.
